While the Safe Harbor provision is working quite well to provide rules of the road for companies like YouTube, the anti-circumvention provision is utterly failing to prevent online piracy. It seems the primary beneficiaries of the anti-circumvention provision are tech companies who use it to protect their closed systems from competition.
