Kerr Defends the Third-Party Doctrine

Orin Kerr is a law professor at George Washington University and a blogger on the popular Volokh Conspiracy. He is a thoughtful, open-minded legal scholar, but I don’t think it’s unfair to say that he reliably sides with law enforcement on Fourth Amendment issues.

  • Professor Kerr should have no objection to the federal government monitoring every single last action he takes that doesn't happen entirely in his own home. The moment he communicates or interacts with the outside world, the monitoring starts. Everything from grocery records, to bank statements, to emails, all monitored.

    It's the third party rule writ large. He shouldn't have any reason to complain.
  • Kerr spends a good deal of time explaining how third parties like phone companies, ISPs, online banks, and such allow people to hide illegal behavior that would otherwise take place in public.

    That's a slippery slope if there ever was one--the same could be said for draperies.
